1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and FashionCatalog ("we," "our," or "us") governing your access to and use of our website and AI-powered virtual try-on platform.

By accessing or using our platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our platform.

2. Account Registration

To access certain features of our platform, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

3. Subscription and Payments

We offer various subscription plans for our platform. By selecting a subscription plan, you agree to pay the applicable fees as described at the time of your purchase. All payments are non-refundable except as expressly set forth in these Terms or as required by applicable law.

Subscription fees are billed in advance on a monthly or annual basis, depending on the billing cycle you select. Your subscription will automatically renew at the end of each billing cycle unless you cancel it prior to the renewal date.

4. User Content

Our platform allows you to upload, store, and process garment images and related content ("User Content"). You retain all rights to your User Content, but you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display your User Content for the purpose of providing and improving our platform.

You represent and warrant that:

• You own or have the necessary rights to your User Content
• Your User Content does not violate the rights of any third party
• Your User Content complies with all applicable laws and regulations

5. Intellectual Property

The platform, including its content, features, and functionality, is owned by FashionCatalog and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our platform without our express prior written consent.

The FashionCatalog name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of FashionCatalog or its affiliates. You may not use such marks without our prior written permission.

6. Prohibited Activities

You agree not to:

• Use the platform in any way that violates any applicable law or regulation
• Use the platform to transmit or upload any material that contains viruses, trojan horses, worms, or any other harmful or destructive code
• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the platform
• Use any robot, spider, or other automatic device to access the platform
• Impersonate or attempt to impersonate FashionCatalog, a FashionCatalog employee, or another user
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the platform

7. Limitation of Liability

To the maximum extent permitted by law, FashionCatalog shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the platform
• Any conduct or content of any third party on the platform
• Any content obtained from the platform
• Unauthorized access, use, or alteration of your transmissions or content

In no event shall our total liability to you for all claims exceed the amount you paid to us during the 12 months preceding the event giving rise to the liability.

8. Disclaimer of Warranties

The platform is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. FashionCatalog disclaims all warranties, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the platform will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected.

9. Termination

We may terminate or suspend your account and access to the platform immediately, without prior notice or liability, for any reason, including but not limited to, a breach of these Terms.

Upon termination, your right to use the platform will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the federal or state courts located in San Francisco County, California.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our platform after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the platform.
